GRILLS V. THREADGATE In this case, John Grills, of Glendon, sued Thomas Threadgate, of Glendon, as follows :- For that the defendant agreed with the plaintiff in manner following- That the plaintiff was to plough and sow with wheat twenty acres of defendants land, situate in the district of Singleton, and to receive half the profits of the said land ; and although the plaintiff had fulfilled his part of the said agreement, and ploughed and sown the said land, yet the defendant has neglected and refused to allow the plaintiff his half of the profits of the said land, namely, one hundred bushels of wheat, being half the amount of the crop reaped from the said land, and the plaintiff claims damages 50 pounds and the plaintiff sues the defendant for refusing to deliver to him one hundred bushels of wheat, although demanded, to his damage of 50 pounds For the plaintiff, Mr. Mullen. For the defendant, Mr. Briggs. From the evidence it appeared that about the month of July the parties to this suit dissolved partnership, but are still neighbours. The land where the wheat was sown was occupied by the defendant, and as they had never settled, the plaintiff went to defendant s land in order to reap his portion of the wheat when it was ripe, but was prevented by defendant, who reaped and thrashed the wheat, and refused to deliver up one-half, which the plaintiff claimed. For the defence, it was submitted that the plaintiff had kept a lot of potatoes and a quantity of millet which were growing on the land when the separation took place. Verdict for the plaintiff
