Details: Action of ejectment in which Richard Swan, plaintiff and John McDougall and Thomas Clifton defendants......Action brought to recover possession of some land on the paterson River formerly in the possession of John Swan. This John Swan had the land for many years and died in 1833, leaving his son Richard Swan heir at law. John Swan left some younger children, but none entitled to claim the land; he also left a widow who died in 1845 or 1846, and after her death the plaintiff claimed the property as heir at law. In the course of the case it might be shown that he also claimed it by another title. His only difficulty arose from this circumstance, that Richard Swan was left in England by his father, and did not come to the colony until after his fathers death; and an attempt might probably be made by the other side to throw doubt on the identity of the plaintiff with this Richard Swan.............For the prosecution William Dun, Byfield Walmsley, Edward Payne, Abraham Finn, John Reynolds, John Swan and Rev Middleton were examined. It appeared that in 1831 Swan first expressed his wish to leave his landed property at Lemon Grove Paterson River between his son Richard and his daughter Jane, now Mrs. Smith. A will was shaped out by Mr. Dun to this effect but was never executed. He wrote to his son pressing him to come out and after John Swans death in 1833, his widow Margaret Swan wrote to Richard Swan to the same effect and the plaintiff at length came out and resided with her at Lemon Grove for a year when he removed to another house on the same farm. This Mrs. Margaret Swan who had no children died a year or two back and Richard Swan then claimed the whole farm as heir at law but some younger children of ohn Swan by a previous wife in this colony claimed and kept possession of a large portion. Mrs. Swan the widow always called Richard her son and treated him as one of the family. Edward Payne had know n Richard Swan in England, residing with his mother who stated that her husband John Swan resided in NSW, and had nown him again residing with the widow Swan at Lemon Grove.....Jury returned a verdict for the plaintiff
