Details: Henry Hughes being sworn states - I was assigned servant to Mr. Bingle in September last and am a shepherd. I was brought up for neglect by the overseer John Tuckey, he had never to my knowledge found fault with me before. A fortnight after I had committed the offence I was brought up by the overseer. I thought I had been forgiven. I was punished at Mr. Ogilvies. I received one hundred lashes - fifty in the evening and fifty in the morning. Captain Pike tried me and in Mr. Bingles house. Mr. bingle was not present during the first part of my trial. He came in during the last part of the trial and gave me a bad character. At the time I was tried, I had been without shoes or boots for some time. I cannot say I was due

Details: Charles Dix, per ship Isabella, assigned to John Bingle, charged with leaving his station without permission. John Bingle states that about three weeks ago the prisoner came down from his station without permission stating that he wanted a shirt when he had been furnished with a shirt only two months before and likewise a pair of trousers and subsequently a pair of shoes and a frock. The prisoner came into my service about the month of May. The prisoner reported himself sick to the sheep overseer and said that a cart must go up to the station for him.....John Tuckey, states - I am sheep overseer to Mr. John Bingle. The prisoner left his station without permission about a month ago, about a fortnight ago when I was at the station he reported himself so sick that it was necessary a cart should go up and bring him down. I then told him to come down, he said he could not walk. I then said he must wait until a dray could bring him. He however, did not wait but started by himself and came the first day as far as Mr Coxens, not less than ten miles, and the next day came home to the farm....John Wiseman, constable stated that on Saturday last after being at court the prisoner went home the same day Mr. Bingle ordered me to take the prisoner in charge and desired me to observe how he walked. I did so, he kept up with me at the rate of three miles an hour and except that he walked with his legs wide apart, he walked as well as I could. The prisoner in his defence states he has been twice out for the gravel and is still affected with that complaint and that is the reason he cannot work.....The Bench are of opinion that he disobeyed orders by leaving his station without permission and although he had the complaint of which he complains, not to such an extent as he states. The Bench find Charles Dix guilty and sentence him to 14 days solitary confinement in the cells at Newcastle and to be returned to his master, being in the first instance taken to the surgeon for examination

Details: John Wilson per ship Georgiana assigned to John Bingle, charged with neglect of duty. Mr. John Tucky, overseer to Mr. Bingle states - The prisoner John Wilson is employed as a shepherd; on Saturday evening last being informed that he had lost some of his flock I went and counted them and found that there was 7 short of the proper number. Wilson states that three were taken when dogs rushed his flock and that they divided in various directions. 3 of the 7 above have since been found dead much torn.....As it is probable that a flock of sheep might be rushed by native dogs in a bush country this Bench decides that the prisoner shall have the benefit of the doubt but caution him not to rely upon such a doubt in future

Details: Charles Brewhouse per ship Marquis of Hastings, assigned to John Bingle, charged with insolence and ill using sheep. John Tuckey, overseer to John Bingle states - On Monday last I went to the sheep station where the prisoner is the watchman. 5 ewes were left in his charge during the day with lambs. Finding 3 of them were away I enquired for them. He said they were not ar away. I went to look for them. Whilst I was away the prisoner put two flocks of sheep into their pens without counting them. I asked him why he did so. He replied it was so late. The sun was not quite down at the time - I desired him to count in the other flocks - some of the young lambs were difficult to get into the hurdles. Some two or three ewes after they were in ran out to their lambs, when the prisoner took up a stick and began to ill use them. I told him not to do so but he continued to poke the ewes all the time. I was in the pen and until I left that pen and desired him to leave the sheep altogether and go away - I then picked up the stick he had been using and told the prisoner I should take it to court to shew - he then took up one something larger and told me not to make a fool of him. And then said he would let me know that he would have the sheep in before sun down another night. This was said in an impertinent manner. The prisoner does not deny the charge but says the 3 ewes were not away being only a short distance from the hurdles. The Bench find the prisoner guilty and sentence him to 50 lashes

Details: Nathan Goodman per ship Mermaid, assigned to John Bingle. Appeared before the Bench to make a complaint of want of proper slops. The prisoner produced to the Court a cloth jacket made out of a soldiers great coat. John Tuckey states - I am overseer to Mr. Bingle; in addition to the jacket now produced by the prisoner who is a shepherd he had a great coat allowed him to wear when he is out at night in wet weather. The Bench having examined the jacket find that it has two holes in it, but evidently from accident and not from wear (which Mr. Bingle requested to have repaired), otherwise the bench think the jacket perfectly good and sufficient

Details: James Reynolds per ship Marquis of Huntley, Charles Brewhouse per ship Marquis of Hastings, Charles Dix per ship Isabella all assigned to John Bingle, all charged with neglect of duty. John Tuckey states - I am overseer to Mr. Bingle and the prisoners Reynolds and Dix are employed as shepherds and Brewhouse as watchman; on last Thursday as I was going down the creek I found only half of the prisoner Reynolds flock on this side of the creek and the others half on the other side of the creek at a considerable distance from the others. I did not see the prisoner until I had brought them across the creek to the other part of the flock. I then saw him and asked where he had been ; he said he had been there all the time; he Reynolds has particular orders not to cross the creek with the sheep; on Friday last the prisoner Dix allowed a native dog to get into his flock which separated twenty six from the flock, since which on Monday last the prisoner brought home his flock two short of which he could give no account; on Monday morning about daylight I heard a noise and got up and saw the four flocks under the charge of the prisoner Brewhouse all out of the folds and admixed together. I went to the prisoners watch box and found him there but not asleep. I asked how he allowed him sheep to get out; he said he was unwell; he however got up and assisted me to collect the sheep and neither before nor since has expressed a wish to go to a medical man who he must know as living on the spot. The prisoner Reynolds states in his defence that he was sitting near his flock mending his trowsers and that he has bad sight and could not see well. The prisoner Brewhouse states in his defence that he was unwell and not able to get up. The prisoner Dix states that he did his best to keep his sheep together. The Bench find the prisoner guilty and sentence them to fifty lashes each
