Jeremiah Horrigan states - I am sheep overseer at Segenhoe and the prisoner is employed as a shepherd; on Thursday morning last he lost his flock of sheep and did not report it to me until the evening. I asked him how he came to lose them; he said that he lost sight of the about half an hour after he left the station. I went after them the following day and found 12 dead and 25 wounded by native dogs and seven are still missing. I brought the rest of them home to the station and the watchman desired the prisoner to take care of them which he refused to do; and the following day I told him myself to take care of them for two days until I got another man to look after them but he refused to do so; I then gave him a pass to got to the farm. The accompanying certificate from Dr. Macrredie stating the prisoners ability of following his occupation as shepherd was handed to the bench.......I hereby certify that Patrick Geary is capable of following his occupation as a shepherd and that it was unnecessary for hi to leave his station on the plea of indisposition - signed John Macredie M.D.....The prisoner states in his defence that he was not able to follow the sheep. Details: Patrick Garry per ship Jane, assigned to Thomas Potter Macqueen, charged with disobedience. Jerry Horrigan states - he is a sheep overseer at Segenhoe; the prisoner (Garry is under his directions; yesterday week he came to the deponent and requested a pass to go to the farm as he was unwell which the deponent refused because there was no man to take charge of his flock but deponent told him that he should let him go as soon as Mr. Dow returned home which would be in a few days ( or words to that effect). So the prisoner went away and left his flock which the deponent was obliged to take care of himself until four days after when he (Garry) returned. The distance is about 25 miles from the station to the farm. Dr. John Maccredie states - Garry came to him yesterday afternoon and upon being asked if he wished to be taken into hospital he said no, that he had come down to get some shoes; the prisoner has complaint upon him of long standing but was not in such a situation that a delay of a few days would materially effect him. The prisoner states in his defence - the overseer never said to him that he would let him go to the doctor in a few days or any words to that effect. The Bench find the prisoner guilty and sentence him to sixty lashes, being the third conviction
