Details: James Small, per ship Asia, in the service of Mr. George Sparke charged with disobedience of orders and insolence to his master. Mr. George Sparke states - On Friday morning last I ordered the prisoner to take the cattle out and not to return before sunset - but during my absence in the middle of the day he returned and stopped as I was informed three or four hours. On Saturday last on my return home from Newcastle, instead of his being with the cattle I found him at home, and when I asked him the reason, he gave me a saucy reply. At night when he brought in the herd, nine or ten were missing. When I asked him why he had returned without them, he replied - Damn and blast the cows to hell - with much abusive language besides.....The prisoner admits having said dang (not damn) their eyes. Denies having used any insolent language to Mr. Sparke. James Small sentenced to 50 lashes
