Details: Thomas Bott Humphreys of Aberdeen appeared on summons to answer the complaint of Chief Constable Dennis Kenny for a breach of the Licensing Act. Witnesses were James Moore who was in the employment of Thomas Perry as overseer and storekeeper, Thomas Augustus Perry Esq., Murtagh O Connor who came free to the colony in July 1838 and was in the employment of Thomas B. Humphreys, George Lewis, free who lived on the Aberdeen estate Sterling Minor, free, Mr. Ralph George Martin who resided in Aberdeen. The defendant was convicted and ordered to pay a fine of 30 pounds and costs

I saw the prisoners on Saturday afternoon in the street, they were drunk and fighting with palings, throwing brick bats at each other. John Large states....I took Bryant in charge, he threatened to strike me....Samuel Bryant sentenced to hard labour for 4 weeks this being his 3rd offence; Richard Bevan sentenced to hard labour for 2 weeks; William Perry sentenced to hard labour for 3 weeks being his 2nd offence, John Cruise sentenced to hard labour for one week

Details: James Collins, in government service, charged with attempting to commit a robbery. William Perry, assigned servant to Mr. Smith states - last night between the hours of 9 and 10, I heard a noise outside the house where the poultry are kept. I ran out and caught Collins close by the entrance. I asked him what he was doing there. He said he came for some tobacco. The place where I found Collins was not a thoroughfare. The prisoner states - I was in a state of intoxication last night, and in endeavouring to get to my quarters I missed the road and got upon Mr. Smiths Premises and fell against the house where Perry was. I had no intention to do wrong. James Collins sentenced to 50 lashes and to work in the gaol gang

Details: William Perry in service to Mr. John Smith charged with frequent drunkenness and repeatedly absenting himself from duty. Mr. John Smith states - since my last complaint to the Bench against Perry, he has frequently given me cause of great dissatisfaction at his conduct both by absenting himself and by drunkenness. On my return yesterday from my farm, I was informed that on the preceding day he together with my stock keeper had been neglecting their duty and getting drunk the consequence of which was that my cattle had strayed away and were only found this morning. My wife tells me that Perry absolutely refused to do his work. George Smith States Perry was away from the house the whole of Thursday and I was desired by my mother to go about the town to look for him; I found him and our stock man in a house in Wellington Street. He did not do any work that day. He frequently absents himself and gets drunk. William Turvey states - I was desired by Mrs. Smith Thursday afternoon to bring Perry to her house. I did so. She asked him if he would do his work. He said he could not. He was not drunk but he had been drinking. At the request of Mrs. Smith I took him to the watch house. The prisoner in his defence states that he was unwell and unable to work and that Mr. Smith had told him he was to do no work about the house but only to slaughter the cattle. This was denied by Mr. Smith. William Perry sentenced to 50 lashes and to be returned to his master

Details: William Perry in service of Mr. John Smith charged with neglect of duty and drunkenness. Mr. John Smith states - On Saturday a short time after my return from Wallis Plains, I went into the stable to see if my horse which I had rode down had been properly dressed by Perry whose duty it is to look after him. I saw that the horse had not been touched and Perry was absent. I found him at Mr. Cheer s public house in a state of intoxication. Francis Macnamara, a constable states - On Saturday evening about dusk I assisted to take Perry to the watch house. He walked there but I did not consider him at the time fit to do his duty from the effects of intoxication. The prisoner states - I expected some of the other servants would have taken care of the horse. I was absent but a short time when Mr. Smith had me taken to the watch house. Sentenced to 3 months in the gaol gang and to be returned to his master at the end of that time if required.

Details: William Perry in the service of Mr. John Smith. Charged with neglect of duty and drunkenness. The prisoner has been in my service some months and up to Christmas last has behaved well, since which, period he is in the constant habit of absenting himself from his work and getting drunk. I have repeatedly remonstrated with him and threatened him with punishment but in vain. The prisoner makes no defence. Sentenced to 50 lashes. Mr. Smith having requested the bench to take into consideration the former good conduct of the prisoner, it is ordered that the infliction of the punishment be suspended for the present but to be put into execution whenever it is proved that he has been guilty f a repetition of his offence
