Details: James Lloyd, free by servitude, employed by James Scott, as his yearly servant charged with neglect of work and disobedience or orders. John Murray states I am overseer to Mr. Scott; on Monday the 8th inst, Lloyd was employed in putting caps in a stock yard along with another free man. I went to them about 9 oclock to see how they were getting on. Lloyd told me that one of the caps had fallen upon him and wished me to give him another man. I said I would after breakfast. After breakfast I found Lloyds did not turn out with the other men. I went to the hut and asked him why he did not go to his work. He replied he was not able. I went to him the following day and he then said he was not able to work, and the same on Wednesday. On the same evening after sun down I went to him and asked him if he intended to work the following day he replied he would tell me when tomorrow came . I would not allow it that he should either to go to work the following morning or go before a surgeon to ascertain whether he was sick or not, he got in a passion and called me by every improper name he could think of telling me at the same time that he was thinking of going to work the following day, but that now he would not go until he thought proper. Case remanded
