Details: Charles Merrett per ship Neptune, assigned to William Buchanan, charged with neglect of duty and insolence. Robert Paterson states - I am overseer to Mr. Buchanan; on Saturday last the prisoner came to me for a cross cut saw to fell some trees for sawing. About two hours after I went to see how he was getting on; when I went to the place I could see no one; I then went beyond the Col Dumaresqs sheep station about a mile and a half from the place where the prisoner should have been at work and found him by some trees which he said he had felled for Mr. Wightman. I asked him who gave him permission to leave his masters work. He said he took it; and yesterday morning I sent his rations to him by a man named Barrett; the prisoner came back a short time after with the meat in his hand and asked me if that was the meat I sent him. I told him I did not send him particular piece. He then threw it upon the floor and said here I make you a present of it.. The prisoner states in his defence that he had permission from his overseer to cut the logs. The overseer says that he gave him permission to go one Sunday to cut a log but the transaction alluded to took place on a Saturday early in the morning. With respect to the meat he says that it was the part next the neck and a great part of the flesh was cut off. The Bench find the prisoner guilty and sentence him to receive fifty lashes
