Details: Patrick McKittrick per ship Eliza, assigned to Col. Dumaresq, charged with neglect of duty....John Marra states - I am sheep overseer to Col. Dumaresq. The prisoner is employed as a watchman over two flocks of sheep and he neglects his cows and calve by letting the cows go away and not bringing them back for a day and a night on Wednesday morning. On my going to the station the shepherd was cutting the ropes to let the calves go as they were starving. I asked the prisoner how he did not keep his cows at home - he told me he had no shoes to follow them and I asked him if he could not keep them near the hut. He told me he wanted a sleep every day. I told him if he did not get them home that day I should take them away. On Thursday morning I went up the cattle run to see if the calves went to the cows. I then brought the cows and calves home to the farm and in coming by the station he was standing with two men who were making hurdles. He asked me if I was going to take the cows home. I told him as he could not attend to them I should take them home when he became very insolent and that he has never cut a stake for his folds since he went to the station and whenever I speak to him he gives me abuse....The prisoner Patrick McKittrick, states in his defence that he does not know the run and that he had no shoes to follow them. The Bench find the prisoner guilty and sentence him to receive thirty six lashes

Details: Robert Jones, per ship Layton, assigned to Col. Henry Dumaresq, charged with neglect of duty....John Marra, states - I am sheep overseer to Col. Dumaresq and the prisoner is employed as a shepherd and on Saturday last he left his flock and another shepherd picked up a part of them and brought them home with his own flock. On Sunday morning I counted them out and found 172 away. I picked up 69 of them and the prisoner and another shepherd picked up the remainder of them in the course of the day except one that was killed near the yard. The prisoner was brought to court this day fortnight on a similar charge and it is 3 or 4th time he has lost them within a short time. The prisoner states in his defence he did not lose his flock - that they were rushed by a dog and his flock divided and he saw part of them join another flock and he called to the shepherd to take care of them until I went after the other part of the flock which were found next day a short distance from the place where they were last.....The Bench find the prisoner guilty and sentence him to receive fifty lashes. Punishment remitted in consequence of the prisoner promising to do better and having been formally a good shepherd

Details: James Honey in the service of government charged with stealing from a fellow prisoner in Church. Charles Hilliard states...I was at Church yesterday. Honey was next to me. When I went to Church I had two dumps and 3 pence coppers amongst which were two farthings. I had also some lint for dressing my leg. During the service I heard some money rattle as if falling into Honeys pocket. It gave me a suspicion that it was mine and on searching for my money it was gone; a constable was behind me. I whispered to him my loss and my suspicion of the thief. The lint was picked up at Honeys feet. He was taken into custody by the constable. After the service was over I recollected that I had hid my money in the waist band of my trousers and on examination I found it there. I have it now about me. (Produced dumps and pennies but no farthings). Charles Merriott, constable, states - In consequence of the communication made to me by Hilliard yesterday, I took the first opportunity that offered without disturbing the congregation to take Honey out of the church. I had previously picked up at his feet some lint and dressing. I searched Honey out of doors and found on his person two dumps and three pence among which were two farthings. Hilliard mentioned the two farthings to me most particularly when he told me he had been robbed. Hilliard pressed me very anxiously not to give evidence against Honey. Hilliard persists in stating that he had made a mistake in charging Honey with the theft but could not give any satisfactory explanation relating to the farthings. James Honey sentenced to 50 lashes and 3 years to a penal settlement. In consequence of the gross prevarication of Charles Hilliard, thereby attempting to screen a thief from punishment, he is sentenced to receive 50 lashes

Details: John Marland charged with gross neglect of duty in concealing the circumstances attending the recovery of some blankets which had been stolen. Margaret Roach states...about six weeks ago all my bedding was stolen from me. ...Marland at that time cohabited with me. I suspected him of having a hand in the robbery. We thereupon separated. On Wednesday last I met Marland in the street and he told me he should never be easy until the blankets were found. On Friday he brought me my two blankets which he said he had found in the bush but begged me not to mention it to the Chief Constable, but as soon as I had got my blankets I reported it to him. The Chief constable states...In consequence of what Margaret Roach had told me I considered the conduct of Marland to be suspicious and that it required explanation. I took the blankets and gave them to Charles Marriott to carry to the watch house. They were stolen from there in the early part of the night. Marland suggested they might probably be secreted and was desired to search. I watched him and saw him go towards the Priests premises which are in a contrary direction to the place mentioned by Marland. I got over the fence of the Priests Garden and there found the blankets . John Marland states...last week John Cooper a miner told me he had sprung a plant in the scrub leading to the Brickfields, that he had found some blankets and indicated to me where they were. I accordingly went thither and on seeing them I ascertained they were those Margaret Roach had lost. I therefore returned them to her. John Cooper states...last week I found some blankets in the bush. They were quite dry they could not have been lying where I found them many days as had that been the case in consequence of the late heavy rains they would have been thoroughly soaked; I mentioned my having discovered them to Marland the Constable who I believe fetched them away. John Marland having tendered the resignation of his situation of constable it is accepted.
