Details: Thomas Butler and John Davis both in government service charged with theft....Thomas Ireland states...The day before yesterday I came down the river in a boat from Patersons Plains. On my arrival at the wharf I left the boat in charge of a man. I told him to take care of a shooting jacket belonging to me in the pockets of which were a pound of tobacco, a pair of spectacles and some papers and orders for money. I also left three dozen eggs in the boat. On my return to it I missed all the articles. The man in whose care I had left them told me he had occasion to be absent a few minutes upon a pressing call and when he returned he perceived the boat had been robbed. In the course of the same evening I met butler with a jacket on his arm. He asked me if I would buy it. I recognised it to be my own and claimed it; He gave it up without hesitation. The pocket had been emptied. Butler in his defence states he got the jacket from Davis who requested him to sell it for him which he did, not knowing it to have been stolen. Davis denied the statement of Butler he calls upon Maclean...Question by Butler to McLean, Were you not present in the hut when Davis gave me a shooting Jacket to sell. Answer...I was hut keeper during the whole of the day before yesterday but I did not see Davis give you anything to sell for him, but I saw you there drunk with a shooting jacket under your arm. Sentence: Thomas Butler 50 lashes. John Davis No proof, discharged. N.B. There being some favourable circumstances attending Butlers case, his punishment is forgiven.

Details: James Cobb in the service of government charged with theft. The chief constable states on the 5th instant I took possession of a boat belonging to Thomas Ireland in consequence of some government slop clothing being found in it, the boat was unloaded at the wharf and Irelands own property taken at his request to the pilots. Yesterday when Ireland was examining his things he missed a jacket a pair of shoes and some gunpowder. Cobb was present when he missed the articles and said he did not know what had become of them, Cobb had assisted in unloading the boat and removing Ireland s property to the pilots, Cobb said he had a strong suspicion where they were and of who had stolen them. I had a strong suspicion too and I directed a constable to go immediately and search Cobbs bedding, he did so and returned with the gunpowder and shoes and for the court……. William Turvey a constable states in obedience to the orders of the chief constable, I searched Cobbs bed it was tied in a blanket on emptying it I found the shoes and gunpowder which I delivered to the chief constable. Thomas Ireland states the shoes before the court are mine, they were stolen from me I believe yesterday morning also a jacket and some gunpowder. I believe the powder to be mine. James Cobb in his defence states that his supposes the articles were put by mistake into his bundle of bedding. Did not know they were there, did not steal them. Sentenced to 2 years to a penal settlement.

Details: Extract - In the Supreme Court of New South. Wales. Sheriffs Office, Sydney, 31st December, 1868. Robertson v. The New South Wales Co-operative Coal Mining Company. BY virtue of the authority given by the Act of Council, 5 Vict., No. 9, the Sheriff will cause to be sold by public auction, on Monday, the 8th day of February, 1869, at noon, at Camb s Commercial Hotel, King-street, Sydney, unless this writ be previously satisfied, All the right, title, and interest of the defendants of and in the equity of redemption, and all other right, title, and interest of said defendants, the New South Wales Co-operative Coal Mining Company, of, in, and to a certain term of 21 years, from the 1st day of October, 1861, of and in the several mines, minerals, lands, and hereditaments, and rights, hereafter described, created by a certain indenture or mining lease, bearing date the 12th day of February, 1862, and made between George William Brooks, John William Brooks, Atwill Kenrick, and Hannah Euphemia, his wife, and William Hampden Platt and Mary Eliza, his wife, of the one part; and George Curless, Thomas Alnwick, Thomas Hale, James Richardson, Benjamin Lunn, James Lindsay, Richard Hale, and Job Morgan, of the other part; and also, all the estate, right, title, and interest of the said defendants of, in, and to the equity of redemption of and in a certain sub-lease by way of mortgage, for the whole of such term less seven days thereof, of and in the same mines, minerals, lands, hereditaments, rights, and term of years aforesaid, made by indenture bearing date the 4th day of June, 1866, and made between the said George Curless, Thomas Alnwick, Thomas Hale, James Richardson, Benjamin Lunn, James Lindsay, Richard Hale, and Job Morgan, of the first part, the defendants, of the second part; and William George Laidley and Thomas Ireland, of the third part, whereby all such mines, minerals, lands, hereditaments, and rights aforesaid, and the said term of years less such seven days thereof, were mortgaged to the said William George Laidley and Thomas Ireland, to secure the payments and performance of certain moneys and covenants in the said indenture mentioned
