Details: Patrick Powers in government service, charged with having stolen property in his possession for which he could not account. James Claridge states - I was at work yesterday at the Commissariat stores I had occasion to go into the stores and I left my waistcoat outside on the Stones, on my return, John Hunter who occasionally assists me at work told me to look out for my waistcoat. I did so, it was gone. I thought Hunter had taken it and I searched him, but he had not got it. The waistcoat now before the court is that which was stolen from me. John Williams states - I was sent by the Chief Constable to the prisoner s barracks to watch what was going forward and to endeavour to find where the waistcoat was. I saw the waistcoat now before the court in Powers possession. I took it from him and delivered it to the Chief Constable. Several of the town gang were standing by at the time I got the waistcoat. The prisoner denies having ever seen the waistcoat in question. Patrick Powers sentenced to 50 lashes

Details: JOHN HUNTER, Farmer and Grazier, Belgrave Park, was born in 1828 in Northumberland, England, and in 1854 arrived in Melbourne. Proceeding to Maitland, he opened a coal mine for the late Mr. Russell -father of 11. C. Russell-and soon got the mine into good working order, remaining there for two years. He then visited the diggings at Rocky River, near Armidale, where he spent twelve months, and afterwards proceeded to Bunnabenow and McCleods Creek, spending nine months on the Fairfield diggings. Here a small fortune was made by a party of nine, which included our subject. In 1858 Mr. Hunter settled in the Clarence district, and in 1861 purchased at a Government land sale his present homestead, consisting of 434 acres of rich agricultural land, cleared, fenced, and well improved, and having two and a-half miles of water frontage to the Clarence River. At first the land was heavily timbered, and the work of clearing it was tedious and severe. Mr. Hunter has experienced unusual adversity, and that he is now a successful man is only owing to his will and steady industry. When starting for the New England diggings he was the possessor of £170 in cash and 2200lbs. of supplies. Before reaching McLeods Creek, where the gold was found, he suffered great privations. He became delirious, and could have died but for the faithfulness and stamina of his mate, who rescued him; they at one time being three days without food. Soon after settling on his present homestead he was attacked by blacks, who endeavoured to kill him in order to secure his tomahawk. A stump still remains in his garden as a sign of the locale of the old conflict.

Details: John Hunter, in service to Edward Gostwyck Cory, charged with repeatedly refusing work and disobedience to the orders of his master and the overseer. Mr. Cory states the prisoner has not been many months in my service, but his general conduct is very reprehensible, he is continually framing excuses to evade doing his work; on Saturday last he was ordered to assist in discharging my vessel which was lying on the beach and refused on the pretence that his feet were injured from the quantity of calomel he had formerly taken. John Tiernan, overseer on Mr. Corys farm states - Hunter if one of the idlest men my master has in his service. On Saturday last he was ordered by my master to assist in discharging the vessel when he refused because his feet could not bear the cold. The prisoner states - we came away last week from my masters farm and our blankets were left behind by my masters orders. We were two nights on the water and arrived at Newcastle on Friday. We remained on board my masters vessel that night and had no blankets to cover us. I cannot go into the water having taken formerly a great deal of mercury and I suffer in my feet from it. Mr. Cory states - I have been obliged to order my overseer to prevent my men bringing their blankets with them to Newcastle as they are generally made away with. There were plenty of sails on board my vessel and they could have had the use of them if they chose in the hold. John Hunter sentenced to 50 lashes, subject to reference to Surgeon Brooks on the alleged incapacity to work from the effects of calomel.
