Details: Proceedings in the Court Room at Newcastle before James Thomas Morisset to inquire into the suspicious cause of a man disappearing in the bush when out as a guide to the military party.....James Humphrys, Private 48th regt., being duly swon deposeth that on 21st instant, he left Michael Browne (constable) who went out with the military party as a Guide some distance at the back of a Hill known by the name of Humphreys Hill, distance about three miles from the settlement. Deponent states at the time of leaving Browne he appeared perfectly well complaining only of his foot being sore from a cut by an oyster shell. He did not see James Gilliland or Edward Mooney, the two soldiers that were with him; did not think they had any dispute with Browne, the man who was missing, they appeared to be on very good terms. He could not conjecture what could have become of Browne but he might have slipped into a place they had to cross of water, it being very high and the evening dark. The cause of Brown not coming into the settlement at the time deponent did was in consequence of one of the military party being taken ill and Browne having his foot sore could not walk so fast, was therefore left in charge of the sick mans musquet to follow after as fast as he could, the party at that time being in distance not three miles off. Others giving evidence included Private James Gilleland of the 48th regt., Private Edward Mooney of the 48th regt., John Menslowe (bush constable), Edward Gaynor (constable); Chief constable John Smith; Surgeon William Evans and two aborigines named Sullivan and Redhead Ben
