Details: Dr. Mallon appeared to a summons, issued at the instance of Edward Mott, a sawyer, for the recovery of £2 18s., detained by the defendant, it appeared that a man named Alexander Jones had been lying dangerously ill, and was lately attended by Dr. Cannan, who, after some time, intimated that there was no hope of the patient recovering, and that medical skill could do no more for him. Mott, and some other friends of the sick man, being apparently dissatisfied with Dr. Caiman's judgment, applied to Dr. Mallon, and requested him to attend the patient. Dr. Mallon (according to the statement of the plaintiff) visited Jones, (who was lying in a state of in- sensibility), and undertook to restore him to consciousness in a short time; for which service he required a fee of two guineas. The terms being agreed upon, a cheque-for £5 was handed to Dr. Mallon, who gave a receipt for the same, certify- ing that he was to retain £2 2s. as his fee. Dr. Mallon bled and otherwise operated upon the patient, who, however, died in about two hours afterwards. On rendering his account, the defendant, in addition to the two guineas for attend- ance, charged for the different operations performed upon the patient. To this charge the plaintiff demurred, and hence arose the present action which was for the balance of the cheque, after deducting £2 2s. The court being of opinion that Dr. Mallon's receipt was a virtual undertaking to perform the services required for two guineas, gave judgment for the plaintiff
