Details: Thomas Richardson per ship Lord Melville, assigned to Peter McIntyre, charged with neglect of duty. Donald McIntyre states - On the evening of the 1st May, I directed the ? to tell the prisoner to put a horse into one of the paddocks and to secure the gate. Next morning the prisoner told me that the horse had got away out of the paddock and that he had found him on the flat. I examined the gate way and found that the 3 lower rails only had been put up and asked why he had not put them all up he said there was no more there. He had the means of securing the gate at hand if he had thought proper or reporting the circumstances of the paddock not being secure; it is his duty to take charge of the horses and his answer to me when questioned were not respectful or satisfactory. The prisoner states in his defence that there was only one rail at the gate way and it was too short that he had been about two years and a half with his master and until now he has always given satisfaction to his master and has never been at court before. The Bench find the prisoner guilty but remit his sentence at the interception of his master and on account of his former good conduct
